Moving from Minnesota to Wisconsin

Residency rules, sticky taxes, and first-year steps (2026)

2026.1 Edition · Revised 2026-07-25 · DomusDay Research

The move changes the rate; the record decides whether it sticks. Minnesota keeps taxing until domicile actually changes, and its 183-day statutory test stays live while any Minnesota abode is maintained. Below: what follows leavers, and the Wisconsin steps that build the record.

Unique rule

Illinois wages, Wisconsin tax: the reciprocity agreement

Wisconsin and Illinois reciprocity means a Wisconsin resident working in Illinois pays income tax on those wages only to Wisconsin — and the reverse. It covers wages, salaries, and commissions, not self-employment, pass-through, rental, or property-sale income. Form W-220 stops nonresident withholding.

Unique rule

30% of long-term capital gains comes off the top

Wisconsin allows a deduction for 30% of net capital gain on assets held more than one year — 60% for farm assets — before applying its 3.50%–7.65% brackets. Illinois taxes capital gains in full at its flat rate; Wisconsin's exclusion narrows the gap for gain-heavy years.

Unique rule

No day-count test — domicile decides everything

Wisconsin has no 183-day statutory residency test. Publication 122 ties full-year, part-year, and nonresident status entirely to domicile, which changes only on abandonment of the old home, acquisition of the new one, and physical presence — each shown by dated actions.

MN → WI: what this corridor changes

Reciprocity with North Dakota and Michigan only — Wisconsin ended in 2010

Minnesota's income tax reciprocity agreements cover Michigan and North Dakota only. The Wisconsin agreement ended January 1, 2010, so Minnesota–Wisconsin cross-border workers file in both states, with credits addressing double taxation of the same income. Who it affects: cross-border commuters, especially along the minnesota–wisconsin line..

Top-bracket rates differ by 2.2%: Minnesota at 9.85%, Wisconsin at 7.65% — an illustration at the top marginal rate, not an effective-rate calculation.

What Wisconsin adds to the record

  • Wage reciprocity with Illinois — cross-border wages are taxed by the resident state only
  • A 30% deduction for long-term capital gains (60% for farm assets)
  • Four brackets from 3.50% to a 7.65% top rate
  • No estate tax (deaths after 2007) and no inheritance tax (deaths after 1991)
  • No day-count residency test — status turns on domicile alone
  • Election-day voter registration at the polling place

Establishing in Wisconsin

The first weeks in Wisconsin matter more than they look: each step below produces a dated document, and dated documents are what answer a Minnesota examiner years later. Do them early and the record starts on your side of the timeline.

Government registrations(4)
  • New residents with an out-of-state license apply for a Wisconsin driver license within 60 days of establishing residency (30 days for a commercial license).

  • Voter registration is available online or by mail up to 20 days before an election, in person at the municipal clerk's office until the Friday before, or at the polling place on election day — each registration requires a proof-of-residence document.

  • Wisconsin has no declaration-of-domicile instrument to record; Publication 122 looks to actions showing intent — the license, registration, voter, and filing records above — plus physical presence in the new home.

Home & property(2)
  • The homestead credit — a property tax/rent credit claimed on Schedule H — requires legal Wisconsin residency for the entire year and 2025 household income under $24,680, so an arrival-year mover generally first qualifies the year after the move.

  • Wisconsin's homestead exemption makes $75,000 of an owner-occupied homestead exempt from execution and from the lien of every judgment by statute — no recording or filing creates it.

Financial(2)
  • Wisconsin requires liability insurance of $25,000 for injury or death of one person, $50,000 for more than one person, and $10,000 for property damage on registered vehicles.

  • A mover who keeps an Illinois employer updates state withholding after the domicile change: under the reciprocity agreement, wages are taxed by the resident state only, so a new Wisconsin resident's Illinois wages shift to Wisconsin reporting.

Filing(2)
  • The arrival year is filed on Form 1NPR, the nonresident and part-year resident return, splitting income at the domicile change date.

  • Publication 122 is the department's residency guidance: full-year, part-year, and nonresident status all turn on domicile, and a change requires abandonment of the old domicile, acquisition of the new one, and physical presence — each shown by actions.

Section FQuestions

Frequently asked on this route

Do Minnesota and Wisconsin still have tax reciprocity?

No — that agreement ended January 1, 2010. Minnesota's reciprocity now covers Michigan and North Dakota only, so Minnesota–Wisconsin cross-border workers file returns in both states, with credits addressing tax paid twice on the same income.

What are the first residency steps after moving to Minnesota?

Converting the driver's license within the 60-day statutory window and registering vehicles within 60 days, with Minnesota no-fault insurance including personal injury protection. Voter registration opens after 20 days of residence — including on election day — and homestead classification is applied for with the county assessor by December 31 for taxes payable the next year. Each step lands on a named factor in the domicile rule.
