Leaving Louisiana

Tax residency rules, audits, and the severance record (2026)

2026.1 Edition · Revised 2026-07-25 · DomusDay Research

Moving out of Louisiana is easy. Stopping Louisiana taxes is a different act, and it happens on paper: Louisiana keeps treating you as a resident until the record shows otherwise.

On the burden of showing otherwise: The department asks for documentation confirming domicile in the other state — the other state's voter registration, automobile registration, and driver's license among them — so the record is supplied by the person claiming the change.

Two tests decide it. Cross 183 days with a Louisiana abode still available and you are taxed as a resident regardless of where you claim to live — and see day-counting rules. Or keep the day count clean but leave the life-pattern evidence pointing at Louisiana, and domicile does the same work. Everything on this page exists to answer one question: if LDR asks, does your record hold?

What makes Louisiana different

Unique rule

Six months of residence pulls in the entire year

The department treats individuals who reside in Louisiana for more than six months as residents for the entire year — not for the months of presence. In a move year that makes the timing of the departure or arrival, and the count around it, the fact that decides how the year is filed.

Louisiana names the five actions it reads as a domicile change

Registering to vote, registering and titling vehicles, obtaining a driver's license, changing children's school of attendance, and obtaining a homestead exemption. A temporary absence from Louisiana, the department states, does not automatically change domicile for income tax purposes.

One rate: 3% flat from 2025

The graduated brackets were repealed for taxable periods beginning on or after January 1, 2025, replaced by a flat 3% on all taxable income, with the standard deduction raised to $12,500 single and $25,000 joint. Estates and trusts pay the same 3%.

Unique rule

The parish homestead exemption is a standing residence claim

A bona fide homestead, owned and occupied, is exempt from state, parish, and special ad valorem taxes to the extent of $7,500 of assessed valuation — $75,000 of market value. Filed once with the parish assessor, it stands while ownership and occupancy continue, and it is on the department's list of domicile actions.

Statutory residency

This is the test with a number in it, and the number is what an auditor can verify line by line. Keep any Louisiana dwelling suitable for year-round use and spend more than 183 days in the state, and Louisiana taxes all of your income — domicile arguments never enter into it. See day-counting rules: a morning meeting, a connection through the city with a dinner on the ground, a single evening — each is a full day against the threshold.

Louisiana states the presence test in months. Alongside it runs domicile: a temporary absence from Louisiana does not automatically change domicile for income tax purposes, and the department expects the intention to change domicile to be confirmed by actions taken to establish a new domicile outside Louisiana.

Residence in Louisiana rather than a defined permanent place of abode: the department states that individuals who reside in the state for more than six months are considered residents of the state for the entire year. The consequence runs to the whole year, not to the period of presence — crossing six months makes the individual a Louisiana resident for the entire taxable year.

Section DTest two — the burden is yours

Domicile

Selling the apartment is not the test, and neither is the new driver's license. Louisiana presumes an established domicile continues until it is shown to have changed — a temporary absence from Louisiana does not automatically change domicile for individual income tax purposes; the taxpayer confirms the intention to change domicile by actions taken to establish a new domicile outside of Louisiana. On the burden: The department asks for documentation confirming domicile in the other state — the other state's voter registration, automobile registration, and driver's license among them — so the record is supplied by the person claiming the change. Examiners weigh 5 primary factors — registering to vote in the new state, registering and titling vehicles in the new state, obtaining the new state's driver's license, changing children's school of attendance, obtaining a homestead exemption in the new state — and they weigh what you did, not what you intended. The pattern of an actual life somewhere else is the evidence; everything else is secondary.

  • Registering and titling vehicles in the new stateNamed by the department in the same list, and requested as proof of the other state's domicile.
  • Obtaining the new state's driver's licenseNamed by the department and requested as documentation; Louisiana's own rule requires a license transfer within 30 days of establishing domicile in the state.
  • Changing children's school of attendanceNamed by the department as an action establishing the new domicile.
  • Obtaining a homestead exemption in the new stateNamed by the department; the mirror is the Louisiana parish exemption, which is a standing claim on a bona fide homestead.
Secondary factors
  • Time spent in LouisianaResiding in the state for more than six months makes an individual a Louisiana resident for the entire year regardless of the domicile narrative.
Section EWhat follows you out

Sticky rules

A clean exit does not end every Louisiana claim. These rules keep taxing specific situations after the move — each one is a way the state stays in your return.

Louisiana-source income of nonresidents

AffectsLeavers who keep Louisiana workdays, Louisiana rental or business property, or a Louisiana business interest.

An individual whose domicile is not Louisiana reports Louisiana-sourced income on Form IT-540B, the nonresident and part-year resident return. Nonresidents and part-year residents file where a federal return is required, reporting all income earned from Louisiana sources.

Six months of residence makes the whole year Louisiana

AffectsAnyone leaving mid-year, and anyone who keeps returning to a Louisiana home for long stretches after moving.

The department treats individuals who reside in the state for more than six months as residents of the state for the entire year. The consequence is not prorated to the period of presence — the year comes in whole, which makes the departure date and the count around it the pivotal facts.

A temporary absence does not change domicile

AffectsMovers on assignment, contract, or seasonal arrangements, and anyone whose out-of-state life reads as temporary on paper.

The department states that a temporary absence from Louisiana does not automatically change domicile for income tax purposes, and asks that the intention to change be confirmed by actions taken to establish a new domicile outside Louisiana — registering to vote, registering and titling vehicles, obtaining a driver's license, changing children's school of attendance, and obtaining a homestead exemption.

The audit program

Louisiana Department of Revenue (LDR) runs a moderate-intensity residency program. The department publishes no residency-specific audit statistics, but it does publish the residency documentation it asks for — the other state's voter registration, automobile registration, and driver's license — when a bill is issued for a year the taxpayer says they were not a Louisiana resident. An examination is not an argument about intentions — it is a request for documents, and the request looks like this:

Documents commonly requested
  • The other state's voter registration
  • The other state's automobile registration or license plate record
  • The other state's driver's license

Every item on that list either exists in your records from the year of the move, or it does not. That is the whole game — and why the severance record below is the section that matters most.

Inset — lookback windows and reported practice

How far back they can reach

Standard
Louisiana prescription for income tax runs three years from the thirty-first day of December of the year in which the tax became due.
Extended
The period may be extended by written agreement between the taxpayer and the secretary, and is suspended by events including assessment, refund claims, and administrative or judicial proceedings.

What states evaluate — and the records that demonstrate it

An audit years from now is answered with documents generated in the months around the move. This is that inventory — grouped the way examiners think about a life, each item paired with the evidence it leaves behind.

Two facts drive the Louisiana departure year. First, residing in the state for more than six months makes the entire year a resident year, so the timing of the move decides whether the year comes in whole. Second, the department treats a temporary absence as no change at all: the domicile change is confirmed by actions — voter registration, vehicle title and registration, driver's license, children's school, homestead exemption — each of which produces a dated record in the destination state. The change year itself is filed on Form IT-540B.

Filing facts

The year of the move is filed on IT-540B, with income split between the resident and nonresident periods — and that return is itself evidence: it states your change date on a signed document. Withholding follows the flat 3% rate for periods beginning on or after January 1, 2025; the standard deduction increase changed the withholding tables alongside it.

Section JQuestions

Frequently asked

How long can someone stay in Louisiana without becoming a resident?

Six months. The department treats individuals who reside in the state for more than six months as residents of the state for the entire year — the whole year, not the months of presence. Alongside that count runs domicile, which does not change on a temporary absence.

What does Louisiana look at to accept a domicile change?

Actions. The department states that the intention to change domicile is confirmed by actions taken to establish a new domicile outside Louisiana, and names five: registering to vote, registering and titling vehicles, obtaining a driver's license, changing children's school of attendance, and obtaining a homestead exemption. It asks for the other state's voter registration, automobile registration, and driver's license as documentation.

Does leaving Louisiana for a work assignment change residency?

Not by itself. The department states that a temporary absence from Louisiana does not automatically change domicile for individual income tax purposes. What changes it is the set of actions establishing a new domicile elsewhere, each of which produces a dated record in the destination state.

Which Louisiana return covers the year of the move?

Form IT-540B, the nonresident and part-year resident return, reporting income earned from Louisiana sources. Residents file IT-540 on all income. Where residence in the state exceeded six months, the year is a resident year in full.

What is the Louisiana income tax rate now?

A flat 3% on all taxable income for periods beginning on or after January 1, 2025, replacing the graduated brackets, with the standard deduction raised to $12,500 for single filers and $25,000 for joint filers. Capital gains sit in the same base at the same rate.

What are the first residency steps after moving to Louisiana?

The driver's license transfers within 30 days of establishing domicile, with the prior state's license surrendered and destroyed. Vehicles are titled and registered with the Office of Motor Vehicles. Voter registration closes 20 days before an election online, or 30 days in person or by mail. The homestead exemption is filed with the parish assessor.
